What Is SB 9 in Los Angeles?

By los-angeles.com EditorialEdited by Last updated Statute sourced, not yet checked by a land-use attorneyReviewed by , Brown & Charbonneau, LLP

SB 9 is a California law, in force since January 2022, that created two rights for the owner of a single-family lot: divide the lot into two legal parcels, or put up to two units on it. Either can be used on its own, and together they are where the commonly quoted ceiling of four units on a former single-family lot comes from.

What makes it different from the planning rules it sits beside is that an application meeting the standards is processed ministerially. There is no hearing, no discretionary review and no neighbor objection that counts against it. That is the whole point of the statute, and it is also why the list of excluded parcels is as specific as it is: the exclusions are doing the work a hearing would otherwise do.

It is state law, so it reaches the whole of California rather than Los Angeles alone. What Los Angeles contributes is the zoning the gate is measured against, the overlays that exclude a parcel, and the department that processes the paperwork. The SB 9 checker runs an address against both pathways.

The two rights, in plain terms

The urban lot split is the one people mean when they say SB 9. It takes one parcel and makes two, each a legal lot with its own address and its own title, which is what separates it from any kind of internal subdivision or lot-line adjustment. Each resulting parcel can then carry up to two units.

The two-unit development is quieter and reaches more lots. It does not touch the parcel boundary at all. It says a single-family lot may hold up to two units, counting whatever is already there, so on a typical lot with a house on it the right being exercised is the right to add one more.

An owner can take either without the other. That is worth stating plainly because the pathways are almost always described as a package, and the exclusions that close one frequently leave the other open.

Each has a page of its own here. How an urban lot split works in LA covers the division, its size tests and the affidavit that comes with it. Building a duplex on a single-family lot covers the second unit, which is the pathway that reaches the most lots.

What SB 9 does not do

It does not override the building code, the fire code or the public health rules. Ministerial approval means no discretion over whether to approve a compliant application; it does not mean an application can skip the standards it has to comply with.

It does not reach multi-family land. The gate is a single-family residential zone, which is a fact about the zone rather than about the house standing on the lot. A parcel in a multi-family zone is outside the statute even though more units are allowed there by right.

And it does not create a right to short-term rental income. A unit created under SB 9 can only be let for terms longer than 30 days.

Why the law is unsettled in Los Angeles

SB 9's application to charter cities has been challenged in litigation. The 2024 trial-court judgment was reversed and the matter remanded for reconsideration under the amended statute; the issue should not be described as finally resolved. The City of Los Angeles currently provides an SB 9 application process. Confirm the current case status and City guidance before relying on this tool. Sources: California DOJ notice of appeal (June 21, 2024); City of Redondo Beach v. Bonta, B338990 (Cal. Ct. App. Nov. 12, 2025) (unpublished; reversed and remanded).

Los Angeles is a charter city, so the question reaches it directly. The practical position for an owner today is that the City continues to accept and process SB 9 applications, and that the point of law is back in front of the trial court rather than settled either way. It is a reason to confirm the position with City Planning before committing money, rather than a reason to assume the route is closed.

Common questions

When did SB 9 take effect?
January 1, 2022. It was signed in September 2021 and applies to applications made from the start of 2022 onward.
Does SB 9 apply to the whole of California?
It is state law and written to apply statewide. Whether it binds charter cities, which include Los Angeles, is the subject of a 2024 ruling and a pending appeal, so the position in those cities is not settled.
Is SB 9 the same thing as an ADU law?
No. The ADU statutes let you add an accessory unit that stays subordinate to the main house on a lot that stays one lot. SB 9 creates units or parcels in their own right, and it carries occupancy commitments and exclusions the ADU statutes do not.
